Warren Buffett Pays a Lower Tax Rate Than His Secretary. The Bracket That Makes It Possible Is Open to Anyone With a Brokerage Account

Warren Buffett Pays a Lower Tax Rate Than His Secretary. The Bracket That Makes It Possible Is Open to Anyone With a Brokerage Account The 0% long-term capital gains bracket lets married couples earning under $32,200 gross income sell appreciated stock and owe zero federal tax. Gain harvesting requires holding shares over one year, and unlike loss harvesting, the wash-sale rule doesn't apply if you immediately repurchase. A large realized gain counts as taxable income, potentially pushing part into the 15% bracket and triggering Medicare IRMAA surcharges or ACA subsidy losses. Are you ahead, or behind on retirement? SmartAsset's free tool can match you with a financial advisor in minutes to help you answer that today. Each advisor has been carefully vetted, and must act in your best interests. Don't waste another minute; learn more here. If you own a brokerage account, you already have access to the same tax bracket that lets Warren Buffett famously pay a lower rate than his secretary. It is called the 0% long-term capital gains bracket, and it lets qualifying investors sell appreciated stock and pay zero federal tax on the gain. No offshore trust required. No Berkshire Hathaway holdings needed. scyther5 / Getty Images The Bracket the World's Most Famous Investor Actually Uses Buffett's low effective rate reflects the source of his income: most of it arrives as long-term capital gains and qualified dividends, which are taxed under a separate, gentler schedule than wages. That schedule has three tiers: 0%, 15%, and 20%. The 0% tier exists in the code every year, and millions of households legally sit inside it. Where the Rule Actually Lives The preferential rates come from Internal Revenue Code §1(h), which governs the maximum tax rate on net capital gain and qualified dividends. The IRS updates the income thresholds annually through a revenue procedure. For tax year 2026, those adjustments were released in IR-2025-103 on Oct. 9, 2025, alongside the broader One Big Beautiful Bill updates. _________________________________ What's Your Number...? Here's a question most people 5y from retirement can't answer: at your current savings rate, how much do you need, and how long will it actually last? A good advisor can put a date on that in a single meeting. SmartAsset's free quiz matches you with up to three fiduciary advisors serving your area, so you can get YOUR retirement number now (sponsor) __________________________________________ The 2026 Numbers That Matter To pay 0% on a long-term gain in 2026, your total taxable income (ordinary income plus the gain itself) must fall under the top of the 0% bracket. For 2026 that ceiling sits at roughly the top of the IRS-published 0% long-term capital gains bracket for each filing status. Stack the 2026 standard deduction on top of that ceiling, and the gross income you can earn before losing the 0% rate is higher: $16,100 for single filers, $32,200 for married couples filing jointly, and $24,150 for heads of households. Translation: a married couple with modest wages and a portfolio can realize meaningful long-term gains and owe the IRS nothing on those gains. Who Qualifies, and Who Gets Shut Out Any U.S. taxpayer with a taxable brokerage account can use this bracket. It is not limited by age, occupation, or filing status. Retirees living off Social Security and dividends fit naturally. So do couples in a low-earning year, freelancers between contracts, sabbatical takers, and new parents on one income. High earners are shut out mechanically: once taxable income crosses the threshold, gains stack into the 15% tier and, eventually, the 20% tier. Gains inside an IRA or 401(k) do not qualify. Those accounts follow their own rules. Harvesting the Gain, Step by Step Confirm the position has been held for more than one year. Anything at 12 months or less is a short-term gain, taxed at ordinary rates topping out at 37%. Estimate your 2026 taxable income before the sale. Subtract the standard deduction from wages and other ordinary income. Calculate the room left under the 0% ceiling. That figure is how much long-term gain you can realize tax-free at the federal level. Sell the appreciated shares. If you still want the position, buy it back immediately. The wash-sale rule applies only to loss harvesting, so no waiting period applies to gain harvesting. Your cost basis resets higher, shrinking any future taxable gain on the same shares. The Catch Nobody Warns You About The gain itself counts toward your taxable income. If you have $40,000 of ordinary income and realize a $60,000 long-term gain, part of the gain pushes you above the 0% ceiling and gets taxed at 15%. Investors misread this constantly. Second trap: states usually do not offer a 0% rate. California, for example, taxes capital gains as ordinary income. Your federal bill can be zero while your state bill is not. Third trap: a large gain can inflate your MAGI enough to raise Medicare IRMAA premiums, phase out ACA subsidies, or make more Social Security taxable. The bracket is generous, but it is not invisible to every other formula the IRS runs on your return. Buffett's secretary paid a higher rate because median full-time weekly earnings hit $1,251 in the second quarter of 2026, and wages get taxed under the ordinary brackets. Investment income plays a different game. Your brokerage account is your ticket in.
